Indeed, the Section One of the Judiciary Act of 1789 established a Supreme Court with six Justices, including the Chief justice and the other five Associate Justices. For inferior courts it did not establish a set number and capacity of the judges who would intervene and left that particular detail to Congress. It also created the Office of Attorney General to represent the federal government before the Supreme Court.
