Technically, yes it is a crime. Despite it being tradition, the people are committing homicide. The book also takes place in rural America where homicide was declared illegal in the 1700s. Had the situation occurred elsewhere in the world, it might not be a crime. From a more complex standpoint, actually convicting people would be difficult as many people took part, but it is nonetheless a crime altogether.
