For purposes of determining discrimination in recruitment, the “relevant labor market” is defined as: the protected class composition of people qualified for the job, and living geographically close enough to be likely candidates
With this definition, the workers that're chosen from the labor market will be determined only by their skills and their ability to commute to the company and not by race, religion, or gender
